Parole Denied (3-6-06)

Dear Darwin & Laura,

RE: PAROLE DENIED AND WHAT COMES NEXT

As I expected and forewarned, yesterday (2-23-06) I was denied parole at my hearing. My next hearing was put off for 3+ years; but the good news is that that can be brought down to one year, with your prompt help. I'll explain that below.

Your outpouring of tremendous letters of support and protest were most beneficial in "making the record" to petition the courts as the next step of this process. I again thank with deep appreciation all who wrote, prayed and contributed; be assured these did IMMENSE good and were not wasted effort. They stated they'd never been so impressed (blown away) with such overwhelming community support and superb parole plans. Thanks to all of you, that is now part of the permanent record for the courts.

But the same falsehoods and tampered evidence that won the conviction in the first place were presented by the deputy D.A. in this hearing, tied into the 20+ years of prison misconduct reports. (There is truly nothing I can do to stop these, as they are maliciously generated in spite of my behavior being continually as proper as any prisoner could possibly be). I presented over 40 recent laudatory reports about me from the honest prison staffers, proving this, but the commissioner admitted that one negative thing will overcome all the positives. (Though the law does not concur with that).

But here is what you can still do to help me correct part of this unfair decision. The present decision is "not final" until the oversight committee, the "Decision Review Unit" finalizes it in the coming weeks. (How long we have varies from a couple weeks to several). Governing regulations (Title 15, California Code of Regulations §2028 and §2041(f)), provide that any person (= you), can write the BPH with comments or new information to affect a more favorable result.

Based on this, I urge those of you who are not too burned out yet, to write, protesting the 3-year denial (put-off), in such a way that stands a realistic chance to be granted (as we won't challenge the denial itself, because I already know that is useless under this, or any, provision short of the courts). Also your letters sent now for this matter will become a part of the record for the courts, which will enhance my chances for relief in my court petition. We will only be asking in this approach for the Decision Review Unit of the parole board to give me what I already have coming; hence a realistic chance to get the next hearing reduced from 3-years to 1-year from now. Everything is already explained in the attached FORM/SAMPLE LETTER which I'm enclosing as a model for you to use as a guideline for your own letter. You can do it VERBATIM if you wish. Since this is a pure-law type of request, it is okay if everyone's letters are the same --or you may modify it as desired along these guidelines. If you wish to receive the Chaplain Francis documentation (proof) before you write the board, ask me immediately, but that delay may make your ultimate letter too late to the board. So, if you are willing, it's best to send your letter promptly to the board, as on this sample/model letter. You'll understand, as you review it, attached here. TIME IS OF THE ESSENCE, because they may act to finalize the decision very soon, within a couple weeks (or it could be longer-we have no way to know). If possible, send copies of your letters to me.
